By accessing or using FaxNow (the "Service"), operated by FaxNow LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We reserve the right to modify these Terms at any time. Your continued use of the Service after any modification constitutes your acceptance of the updated Terms.
FaxNow provides an online facsimile transmission service that allows registered users to send and receive fax documents electronically. The Service includes outbound fax transmission, inbound fax reception via assigned fax numbers, and related account management features.
You must be at least 18 years of age to use the Service. By using the Service you represent and warrant that you meet this requirement and that you have the legal capacity to enter into a binding agreement.
Access to the Service requires registration using a valid email address. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to terminate accounts at our sole discretion.
The following fees apply to use of the Service:
You will only be charged for outbound faxes that are successfully delivered. Failed transmissions incur no charge. All fees are charged in US dollars. By providing payment information you authorize us to charge the applicable fees to your payment method. All charges are non-refundable except as required by applicable law.

We reserve the right to suspend or terminate your account immediately and without notice for any violation of this section.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THAT FAXES WILL BE DELIVERED SUCCESSFULLY TO ANY PARTICULAR RECIPIENT OR WITHIN ANY PARTICULAR TIMEFRAME.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FAXNOW LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, OR ANY OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF WHETHER SUCH DAMAGES ARE BASED ON CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE TOTAL FEES PAID BY YOU TO US IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) TEN DOLLARS ($10.00).
You agree to indemnify, defend, and hold harmless FaxNow LLC and its officers, directors, employees, agents, and service providers from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property right or privacy right; or (d) any content transmitted through the Service by you.
You are solely responsible for ensuring that your use of the Service complies with all applicable laws and regulations governing fax transmissions, including the Telephone Consumer Protection Act (TCPA), the Junk Fax Prevention Act, and any applicable state laws. We assume no responsibility for your compliance with such laws. You represent and warrant that you have obtained all necessary consents and authorizations before transmitting any fax through the Service.
You retain ownership of all documents and content you transmit through the Service. You grant us a limited, non-exclusive license to store and process your content solely as necessary to provide the Service. We do not review, monitor, or take responsibility for the content of faxes transmitted through the Service. We reserve the right to preserve and disclose content if required to do so by law or in good faith belief that such action is necessary to comply with legal process.
We do not guarantee that the Service will be available at all times. The Service may be subject to interruptions, delays, or errors beyond our control. We reserve the right to modify, suspend, or discontinue the Service at any time without notice or liability.
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any dispute arising under or relating to these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Texas.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and FaxNow LLC with respect to the Service and supersede all prior agreements and understandings, whether written or oral, relating to the Service.
